How to Write a Law Essay

In a college legal studies course, and in some law school courses, you may be required to write a research paper addressing a legal topic. These essays can be tricky, because the law is constantly evolving. To secure a top grade, your essay must be well-researched and coherently argued. With proper planning and research, you can write a stellar legal essay. [Note: this article does not address how to write law school essay exams or bar exam questions, which require different techniques and strategies.]

Choosing an Essay Topic

Step 1 Carefully read the assignment prompt.

  • A narrow essay prompt might read, "Discuss the evolution and impact of the exclusionary rule of evidence in the United States." A broad prompt might read, "Discuss how a civil rights movement led to changes in federal and/or state law."
  • If you are invited to choose your own topic, your professor may require you to submit a written proposal or outline to ensure that your chosen topic complies with the prompt. If you are not sure if your topic is within the parameters of the prompt, propose your topic to your professor after class or during his or her office hours.

Step 2 Read any required materials.

  • Hopefully, your course readings, lectures, and class discussions will have given you enough background knowledge to select a topic. If not, review your class notes and browse online for additional background information.
  • It is not uncommon to change your topic after doing some research. You may end up narrowing the questions your essay will answer, or changing your topic completely.

Step 4 Choose an essay topic of interest to you.

  • If you can, try to focus on an are of the law that affects you. For example, if your family is involved in agriculture, you may be interested in writing about water use regulations .

Researching Your Topic

  • If you are prohibited from citing internet resources, you can still use online research to guide you to physical primary and secondary sources in your local library or bookstore.

Step 2 Begin with tertiary sources.

  • Look at footnotes, citations, and indexes in tertiary sources. These are great for finding books, articles, and legal cases that are relevant to your topic. Also take note of the names of authors, who may have written multiple works on your topic.

Step 3 Speak to a librarian.

  • Also find search engines for related fields, such as history or political science. Ask your librarian to recommend specialized search engines tailored to other disciplines that may have contributed to your topic.

Step 5 Gather sources and read them.

  • Never cut and paste from the web into your notes or essay. This often leads to inadvertent plagiarism because students forget what is a quotation and what is paraphrasing. When gathering sources, paraphrase or add quotation marks in your outline.
  • Plagiarism is a serious offense. If you ultimately hope to be a lawyer, an accusation of plagiarism could prevent you from passing the character and fitness review.

  • Provide supporting information drawn from primary and secondary sources that support your argument. Remember to cite your sources.
  • Provide your own original analysis, explaining to the reader that based on the primary and secondary sources you have presented, the reader should be persuaded by your argument.

  • Do not rely on a spell checker exclusively, as it will not catch typos like "statute" versus "statue."

  • You can share the essay with someone outside of class, but a classmate more likely has the requisite knowledge to understand the subject matter of the essay.

They may be able to add another perspective you haven’t considered or suggest another research paper that could add value to your essay. 

10. Proofread For Grammatical Mistakes

Once you’re happy with the content of your essay, the last step is to thoroughly proofread your essay for any grammatical errors. Ensure that you take time to ensure that there are no grammar, spelling or punctuation errors as these can be one of the easiest ways to lose marks. You can ask anyone to proofread your paper, as they would not necessarily need to have a legal background – just strong grammar and spelling skills! 

11. Check Submission Guidelines

Before submitting, ensure that your paper conforms with the style, referencing and presentation guidelines set out by your university. This includes the correct font, font size and line spacing as well as elements such as page numbers, table of content etc. Referencing is also incredibly important as you’ll need to make sure that you are following the correct referencing system chosen by your university. Check your university’s guidelines about what the word count is and whether you need to include your student identification number in your essay as well. Be thorough and don’t lose marks for minor reasons!

12. Use Legal Terms Accurately

Always make sure that you are using legal terms accurately throughout your essay. Check an authoritative resource if you are unsure of any definitions. While being sophisticated is great, legal jargon if not used correctly or appropriately can weaken your essay. Aim to be concise and to stick to the point. Don’t use ten words when only two will do.

12. Create a Vocabulary Bank

One recurring piece of advice from seasoned law students is to take note of phrases from books and articles, key definitions or concepts and even quotes from your professors. What We Know About the Arizona Abortion Ban

The state’s highest court upheld an 1864 law that bans nearly all abortions. Here’s what to know about the ruling.

Arizona’s highest court upheld an 1864 law that bans nearly all abortions, a decision that could have far-reaching consequences for women’s health care and election-year politics in a critical battleground state. But the law is not immediately in effect. The court put its ruling on hold for the moment, and sent the matter back to a lower court to hear additional arguments about the law’s constitutionality.

Here’s what to know about the ruling, the law and its possible impact.

What is the 1864 law?

The law, which was on the books long before Arizona achieved statehood in 1912, outlaws abortion from the moment of conception, except when necessary to save the life of the mother, and it makes no exceptions for rape or incest. It bans all types of abortions, including medication abortions.

Until now, abortion had been legal in Arizona through 15 weeks of pregnancy. Since the overturning of Roe v. Wade nearly two years ago, supporters and opponents of abortion rights in Arizona had been fighting in court over whether the 1864 law, which had sat dormant for decades, could be enforced, or whether it had been effectively neutered by decades of other state laws that regulate and restrict abortion.

Doctors prosecuted under the law could face fines and prison terms of two to five years for providing, supplying or administering care to a pregnant woman.

What does the ruling say?

On April 9, the Arizona Supreme Court ruled in a 4-to-2 decision that the pre-statehood law was “now enforceable.”

The court said that because the federal right to abortion had been overturned by the U.S. Supreme Court in 2022, there was no federal or state law preventing Arizona from enforcing the near-total ban. It noted that the State Legislature had not created a right to abortion when it passed the 15-week ban in 2022.

“Physicians are now on notice that all abortions, except those necessary to save a woman’s life, are illegal,” the court wrote.

Is the law in effect now?

No. The court put its ruling on hold for 14 days, and sent the case back to a lower court to hear additional arguments about the law’s constitutionality.

Because of this 14-day pause, and an additional 45-day delay before enforcement, it will very likely be weeks before the law goes into effect. Abortion providers said they expected to continue performing abortions through May.

It is also unclear what the enforcement of the law will look like. Arizona’s attorney general, Kris Mayes, a Democrat, called the ruling “unconscionable and an affront to freedom,” and said she would not prosecute doctors for providing abortions, potentially opening a new legal fight with Republican prosecutors and abortion opponents.

But the ruling could prompt clinics in the state to stop providing abortions and women to travel to nearby states like California, New Mexico or Colorado to end their pregnancies.

Could the ban be overturned?

Yes. In the majority opinion, the concurring justices said that a “policy matter of this gravity must ultimately be resolved by our citizens through the legislature or the initiative process.”

State legislators could repeal the ban or voters could overturn it in November, if abortion rights groups succeed in placing a measure on the ballot enshrining abortion protections into the State Constitution.

State Senator T.J. Shope, a Republican who represents a suburban and rural area south of Phoenix, said he would work to repeal the 1864 ban but leave in place the 15-week prohibition that was signed into law by the previous governor, Doug Ducey, a Republican.

The former governor denounced the ruling , saying that it was “not the outcome I would have preferred.” He called on Arizona’s elected leaders to “heed the will of the people and address this issue with a policy that is workable and reflective of our electorate.”

The proposed ballot measure would enshrine abortion access until “fetal viability,” or about 24 weeks, in the State Constitution, returning to the standard set by Roe. The effort needs close to 400,000 signatures by July to get on the ballot. The coalition working on the measure, Arizona for Abortion Access, said it had already exceeded the threshold .

How could this affect the 2024 election?

The stakes of this ruling could be significant for races up and down the ballot in Arizona this fall.

President Biden and Democratic officials have blamed former President Donald J. Trump for the dwindling access to abortion care in America. On April 8, Mr. Trump said that abortion rights should be left up to the states.

Democrats, who seized on abortion to win campaigns for Arizona governor and attorney general in the 2022 midterm elections, said the issue of reproductive rights would galvanize their supporters.

Representative Ruben Gallego , running unopposed in the Democratic primary for Senate, criticized the ruling and tied it to his opponent, Kari Lake, who called the near-total ban a “great law” when she was running for governor in 2022.

Ms. Lake has been emblematic of a Republican shift on abortion . She came out against a federal ban last year while still backing Arizona’s 15-week restriction, and said on April 9 that it was “abundantly clear that the pre-statehood law is out of step with Arizonans.”

Representatives Juan Ciscomani and David Schweikert, two Republicans facing re-election challenges in closely divided districts, also criticized the ruling and urged state lawmakers to address it.

Where else is abortion illegal?

Twenty-one states currently ban or restrict abortion earlier in pregnancy than what Roe v. Wade established.

EPA Announces First-Ever National Standard to Address PFAS in Drinking Water, Delivers an Additional $1 Billion through President Biden’s Investing in America Agenda to Combat PFAS Pollution

President Biden believes every community has the right to clean, safe drinking water, free of pollutants that harm people’s health and wellbeing. That is why the President launched a comprehensive action plan and provided billions in funding to protect communities from toxic “forever chemicals” that are linked to a range of severe health problems, including cancers, liver and heart damage, and developmental impacts in children. Found in drinking water, soil, air, and our food supply, per- and polyfluoroalkyl substances (PFAS) persist in the environment for long periods of time, posing a serious health threat across rural, suburban, and urban areas.

Today the Environmental Protection Agency (EPA) is announcing the first-ever national legally enforceable drinking water standard for PFAS , which will protect 100 million people from PFAS exposure , prevent tens of thousands of serious illnesses, and save lives. This action complements the Biden-Harris Administration’s commitment to combatting PFAS pollution and delivering clean water.

President Biden has secured historic levels of funding to meet this new standard. Today, the Biden-Harris Administration is also announcing an additional $1 billion through President Biden’s Investing in America agenda to help every state and territory fund PFAS detection and treatment systems to meet the new standard . This funding is part of the $9 billion in dedicated funding through the President’s Bipartisan Infrastructure Law to address PFAS and other emerging contaminants in drinking water – the largest-ever investment in tackling PFAS pollution. An additional $12 billion in funding from the Bipartisan Infrastructure Law supports general drinking water investments, including PFAS treatment. The investments are part of the  Justice40 Initiative , which aims to ensure that 40 percent of the overall benefits of certain federal investments flow to disadvantaged communities.

These actions will help tackle PFAS pollution that has devastated communities like Oakdale, outside of St. Paul, Minnesota, where decades of PFAS-containing waste dumped by a chemical plant has contaminated the community’s drinking water. In this area, cancer was found to be a far more likely cause of death in children than in neighboring areas. The funding announced today will build on funding from the President’s Bipartisan Infrastructure Law that is already helping communities address PFAS contamination, including a $33 million award for Tucson, Arizona to treat its PFAS-contaminated drinking water wells.

This funding also builds on President Biden’s action plan  to address PFAS pollution , safeguard public health, and advance environmental justice – all while advancing the Biden Cancer Moonshot goal of cutting the cancer death rate by at least half by 2047 and preventing cancer before it starts by protecting communities from known risks associated with PFAS exposure.

As the first-ever Safe Drinking Water Act standard for PFAS – and the first for any new contaminants since 1996 – this rule sets health safeguards and will require public water systems to monitor and reduce the levels of PFAS in our nation’s drinking water, and notify the public of any exceedances of those levels. The rule sets drinking water limits for five individual PFAS, including the most frequently found PFOA and PFOS. Because PFAS can often be found together in mixtures, EPA is also setting a limit for any combination of four PFAS, including GenX Chemicals. This standard will reduce PFAS exposure in our drinking water to the lowest levels that are feasible for effective nationwide implementation.

Today’s announcements advance President Biden’s broader commitment to deliver clean water for every American. The President’s Bipartisan Infrastructure Law invests over $50 billion to upgrade water infrastructure – the largest investment in clean water in American history. This includes a historic $15 billion to replace toxic lead pipes and protect children from brain damage, as part of President Biden’s goal of replacing every lead pipe in the country within a decade.

Recent Federal Actions to Protect Communities from PFAS

Under President Biden’s leadership, nearly two dozen federal agencies and offices have made systematic and substantive progress to safeguard public health and protect the environment from PFAS in drinking water and beyond. This work is coordinated by the White House Council on Environmental Quality, which leads the Interagency Policy Committee on PFAS. Other new actions the Biden-Harris Administration has advanced to combat PFAS pollution over the past year include:

Protecting Firefighters from PFAS : The Biden-Harris Administration is committed to protecting firefighters from the harmful effects of PFAS contained in fire suppressing agents and firefighter gear. The Department of Defense is offering PFAS blood tests to military firefighters. The Federal Emergency Management Agency’s U.S. Fire Administration is working to reduce PFAS exposure and promoting access to early cancer screenings and participation in the National Firefighter Registry for Cancer led by the National Institute for Occupational Safety and Health as part of President Biden’s mission to end cancer as we know it.

Reducing PFAS in Fire Suppressants: The Department of Defense (DoD) qualified three fluorine-free foams to replace fluorinated Aqueous Film Forming Foam for shore-based firefighting activities at military installations, which the Federal Aviation Administration (FAA) has authorized for civilian airports. The FAA is assisting airports to transition to these new foams , and funding foam testing systems for airports that prevent environmental discharge. These changes will reduce the release of PFAS in the environment and protect the health of firefighters and local communities.

Supporting Healthcare Providers: The Agency for Toxic Substances and Disease Registry at the Centers for Disease Control and Prevention recently released the PFAS: Information for Clinicians resource guide. This information gives clinicians up-to-date resources and information they need to help patients with questions and concerns about PFAS exposure and health effects.

Phasing Out PFAS in Food Packaging: The Food and Drug Administration (FDA) announced the completion of the voluntary market phase-out of PFAS used on paper and paperboard food packaging, eliminating the primary source of dietary exposure to PFAS . FDA can now also test for 30 PFAS in a variety of foods to further protect people from dietary PFAS exposure.

Testing for and Cleaning Up PFAS Pollution: EPA continues to take key actions to address PFAS . For example, EPA is gathering data on 29 PFAS in the nation’s drinking water systems has collaborated with DoD to develop a method to test for 40 PFAS in various media including biosolids, groundwater, and fish tissue. EPA also updated its interim PFAS disposal and destruction guidance and has released a new method to test for 30 volatile fluorine-containing compounds in air including potential products of incomplete combustion of PFAS. DoD recently identified 40 installations where interim cleanup actions to prevent further PFAS migration are underway or will start in FY2024. These actions will address PFAS in groundwater to protect public health and the environment.  

Reducing PFAS in Federal Procurement: EPA and the U.S. General Services Administration announced this week that custodial contracts for federal buildings will now only use cleaning products certified to ecolabels such as EPA’s Safer Choice and certain Green Seal standards, thereby avoiding products that contain intentionally added PFAS. This shift will protect the environment, federal custodial workers, other federal employees, and those visiting government buildings.

Gov. Ron DeSantis signed five bills Wednesday that strengthen penalties for crimes against children, increase oversight of sex offenders, and create a "domestic violence lethality" assessment for first responders – a bill pushed by the southwest Florida family of the late Gabby Petito.

"People should just know that we are forthrightly committed. Whatever we need to do to maintain Florida as the best place to raise kids, we're going to do it," DeSantis said at the Urban StillHouse Restaurant and Bar in St. Petersburg. "We're going to make sure that we keep the bad guys at bay."

DeSantis signed "Child Exploitation Offenses ( HB 1545 )," "Online Sting Operations Grant Program ( HB 1131 )," "Sexual Predators and Sexual Offenders ( HB 1235 )," "Protection of Children and Victims of Crime ( SB 1224 )," and "Offenses Involving Children" ( HB 305 ).

Petito's family pushed for SB 1224, which will create a statewide domestic violence lethality assessment. Law enforcement officers who respond to domestic violence incidents will determine whether a domestic violence victim is at a higher risk of death or serious injury.

Petito, who lived in North Port with fiance Brian Laundrie, was a 22-year-old travel vlogger. Laundrie reportedly killed her while on a cross-country road trip  in 2021. Her disappearance fueled intense interest across the nation and spurred  a search for Laundrie , who later died by suicide.

"Gabby's father, Joe, has been supporting and pushing for the language in the legislation, as well as other members of the family and the foundation. Today, we honor those efforts by making this the law of the land in the state of Florida," DeSantis said.

SB 1224 also establishes the Fostering Prosperity grant program, which will connect youth aging out of the foster care system to trade school opportunities, help them prepare for college and provide financial literacy instruction.

“Our residents and law enforcement should have every tool to prevent these terrible people from ever having the opportunity of taking advantage of children. Parents in Florida can rest easier knowing that their children are safe and protected," said Florida Department of Highway Safety and Motor Vehicles Director Dave Kerner.

Here's what the other legislation DeSantis OK'd provides for:

  • HB 1545 will create a new offense on the books in Florida, harmful communication to a minor, a third degree felony. It also increases penalties for child exploitation crimes, such as promoting sexual performances or possessing child pornography.
  • HB 1131 earmarks money to the Florida Department of Law Enforcement to facilitate sting operations targeting online predators who may commit crimes against children. "Florida will be our very own grant program 'To Catch a Predator,'" DeSantis said at the bill signing.
  • HB 1235 will create stricter registration guidelines for sexual offenders and predators, increasing oversight of residences and requiring offenders and predators to register temporary and transient housing addresses, including house boats and cars. It will also require international travel to be reported ahead of time and make it more difficult to qualify for registration removal.
  • HB 305 increases the maximum age to 17 for a hearsay exception in cases of child abuse, neglect or sexual abuse of a child. This means an out-of-court statement is admissible for evidence in court. It also requires someone to register as a sexual predator if they are convicted of a crime relating to human trafficking for commercial sexual activity where the victim is a minor.

DeSantis also took time at the lectern after signing the bills to talk about inflation and rising prices, blaming "Bidenomics" while criticizing the president's initiative to forgive student loans.

"Maybe stop spending so much money up there," DeSantis said.

And the governor hinted at more public safety bill signings this week: "We're proud of being a law and order state," he said.

Law and Order is as important to us as air. And it is equally invisible in the sense that we hardly ever think about it.

It is through centuries that the modern system of law and order has developed. We have our military forces to protect our borders against an attack by any foreign country. Within our country we have a well-organised and well-trained police force to nab all the antisocial elements, including thieves, burglars, pick-pockets, robbers, highwaymen, murderers, etc.

As C.E.M. Joad in one of his celebrated essays has pointed out, had there been no law and order system, all the artistic and scientific advancement which has made life liveable and pleasure some in the modern age would have just nigh been impossible.
