The Constitution of India was written on 26 November 1949 and came into force on 26 January 1950. On 26th January 1950, the Constitution of India came into effect. That’s why 26th January is celebrated as Republic Day in India.

How Was the Constitution of India Formed?

The representatives of the Indian people framed the Indian Constitution after a long period of debates and discussions. It is the most detailed Constitution in the world. No other Constitution has gone into such minute details as the Indian Constitution.

The Constitution of India was framed by a Constituent Assembly which was established in 1946. Dr Rajendra Prasad was elected President of the Constituent Assembly. A Drafting Committee was appointed to draft the Constitution and Dr B.R. Ambedkar was appointed as the Chairman. The making of the Constitution took a total of 166 days, which was spread over a period of 2 years, 11 months and 18 days. Some of the salient features of the British, Irish, Swiss, French, Canadian and American Constitutions were incorporated while designing the Indian Constitution.

Features of The Constitution of India

The Constitution of India begins with a Preamble which contains the basic ideals and principles of the Constitution. It lays down the objectives of the Constitution.

The Longest Constitution in the world

The Indian Constitution is the lengthiest Constitution in the world. It had 395 articles in 22 parts and 8 schedules at the time of commencement. Now it has 448 articles in 25 parts and 12 schedules. There are 104 amendments (took place on 25th January 2020 to extend the reservation of seats for SCs and STs in the Lok Sabha and state assemblies) that have been made in the Indian Constitution so far.

How Rigid and Flexible is the Indian Constitution?

One of the unique features of our Constitution is that it is not as rigid as the American Constitution or as flexible as the British Constitution. It means it is partly rigid and partly flexible. Owing to this, it can easily change and grow with the change of times.

The Preamble

The Preamble has been added later to the Constitution of India. The original Constitution does not have a preamble. The preamble states that India is a sovereign, socialist, secular and democratic republic. The objectives stated by the Preamble are to secure justice, liberty, and equality for all citizens and promote fraternity to maintain the unity and integrity of the nation.

Federal System with Unitary Features

The powers of the government are divided between the central government and the state governments. The Constitution divides the powers of three state organs, i.e., executive, judiciary and legislature. Hence, the Indian Constitution supports a federal system. It includes many unitary features such as a strong central power, emergency provisions, appointment of Governors by the President, etc.

Fundamental rights and fundamental duties

The Indian Constitution provides an elaborate list of Fundamental Rights to the citizens of India. The Constitution also provides a list of 11 duties of the citizens, known as the Fundamental Duties. Some of these duties include respect for the national flag and national anthem, integrity and unity of the country and safeguarding of public property.

The attraction of sailing a boat that offers the vast living space found on a catamaran may one day mean that your average monohull sailor is faced with the need to bone up on how to transfer his seamanship skills to catamaran sailing.

Typically this might crop up when a big family – or a group of friends – is tempted to splash out on a charter of one of these boats in some sunny holiday paradise.

To any reasonably experienced sailor stepping onto a cat shouldn’t represent a huge challenge, but the experience is certainly different enough to merit getting up to speed with it as soon as possible.

Sitting behind the wheel of a docked cruising catamaran for the first time can, when all is said and done, be a bit daunting. All that interior space inevitably imposes some severe limits on visibility for a start.

If you’re on a boat that has separate port and starboard helm stations you may find you’ll have a great view forward and outboard, but the accommodation ‘house’ inboard of you is about as see-through as a brick wall, leaving you with no clue about what’s happening the other side of it.

OK, most of the action will be on the side of the boat against the pontoon as you leave the berth, so you’d naturally start the day here – able to see what’s happening and communicate easily with your line-handlers.

If you’re on a boat with a flybridge you’ll be able to see for miles – and you’ll certainly get a great view of the line-handling and the boat’s movement relative to the pontoon although you may not be able to see what the line handlers are doing as they may be hidden by the coachroof edges.

Coping with windage

You’ve probably taken in the fact that a catamaran with generous accommodation – and that means most of them – also has a huge amount of windage. Most of these boats have fixed centreboards (unballasted keels if you like). Although these are not the most efficient devices for fast upwind sailing they do have enough pure area to stop the boat being blown about like a loose paper bag when manoeuvring under power.

Although the windage issue and poor visibility may seem daunting, there is one built-in characteristic of a catamaran that is there to make your life much easier. Having two engines – especially as they are set so far apart – gives you a secret weapon that can make even a novice look like pro.

This is just as well as the rudders on the average cruising catamaran are smaller than you would like them to be if you needed to depend on them for low-speed manoeuvring. This choice is driven by the desire to reduce draught as much as possible (OK, and maybe the cost as well …).

Manoeuvring with twin engines

In reality, armed with twin engines, you can forget the rudders and just leave them amidships when manoeuvring at slow speed, so you escape that nerve-racking gambit of giving a blast ahead with full rudder and just hoping against hope that she’ll respond in time before clouting the dock (or worse).

That trick can work well on a monohull with high aspect keel and rudder and shallow ends, but on this boat it’s probably best not to be tempted to try it.

So now you’re planning how best to leave the dock and taking a look at wind strength and direction – just as you would on any boat. If you’re on a charter boat you may well find yourself moored tightly between two other catamarans so you need to be able to move the boat quite a way sideways to get clear.

If your boat is fitted with a bow thruster (not very common in cats) you can push the bow away from the dock until you’re clear to head straight out. Don’t forget that the action of the bow thruster will be to rotate the boat (viewed from above) so the stern will be pushing towards the dock as it becomes the pivot point so it will need to be well fendered.

Springing off the dock

If there’s no bow thruster installed you’ll need to spring the boat off the dock by setting a spring line between the bow and a dock cleat somewhere near the stern. This will then be led back to the bow, so that the line can be released from on board by hauling in the running end.

Moving the control of the engine furthest from the dock into slow-ahead – while the boat is restrained by that spring line – should cause the stern to swing away from the dock.

If all goes well when the boat has swung some 45-50° from the dock you should be able to make a stern-first exit out of the space and into clear water as you release the running spring line and haul it aboard. Take care though, because this trick can go badly wrong if the two parts of the line are twisted together – even one or two turns – as the friction created will stop the line running. Even passing that running line through a heavy iron ring on the dock or quay could stop it running – and spoil your whole day.

Once again don’t forget to set fenders from the bow before starting this manoeuvre as the bow could be pushing quite hard against the dock once you apply the thrust from the engine.

Before you get too wound up about the difficulties of clearing the marina for the first time you might take comfort from the knowledge that this may be the most challenging thing you’ll do all week. Try to pick a moment when there’s a lull in the wind. Too much of it will certainly make the whole operation far more difficult – and the consequences of getting it wrong more embarrassing.

Once you’re away from the marina and into clear water you can relax and find some time and space to discover the handling characteristics of this strange new beast by doing some trials – somewhere where you can repeatedly get it all wrong without damaging anything, even your pride.

Do’s and don’ts

  • DO take time to consider where the breeze is coming from as windage plays a bigger part.

  • DO take a look at the slot you need to leave from another angle such as the opposite pontoon.
  • DON’T allow the spring lines to twist together or the friction will stop the line running.
  • DON’T attempt your first manoeuvres in strong wind – in tropical waters things usually quieten down in the evening.
  • DON’T forget that undocking will probably be the most challenging manoeuvre you’ll do for now.

His career began when he studied Boatyard Management at what is now Solent University before opening a sailing school in Bristol and later moving to a multihull yard. He and a friend, Mark Pridie, won their class in the 1978 Round Britain race in a salvaged Dick Newick-designed 31-footer. Later, in 1985, he won the Round Britain Race with Tony Bullimore with whom he was jointly awarded Yachtsman of the Year.

His first major design success came in 1984 when his 80ft LOA catamaran Formule Tag set a new 24-hour run, clocking 518 miles. During the 1990s it was his designs that were dominant on the racecourse: Mike Birch’s Fujicolour , Philippe Poupon’s Fleury Michon VIII , Tony Bullimore’s Apricot . Most famous of all was Ellen MacArthur’s 75ft trimaran B&Q, which beat the solo round the world record in 2005.

His designs have included cruising and racing boats, powerboats and monohulls, but it is multis he is best known for.

Catamaran Parts Explained: Interactive Guide (For Beginners)

Learning a new skill can sometimes be time-consuming, and learning to sail also means learning a new language with tons and tons of new words that, in the beginning, makes no sense at all.

Some of the words you will read about in this article stem from the early days of sailing. Some are only a decade old; in this article, I have tried to compile all the basic terminology that I believe a beginner needs if he or she wants to understand sailing and catamarans.

Main sections on a catamaran

  • Hulls; are what separates a cat from other sailboats, a catamaran has two hulls, a trimaran three, and a regular sailboat, aka monohull, has one. The hull is the part of the sailboat which makes it float and to where all other things are attached. The hulls are usually divided into sections, such as usable and non-usable area. An example of a usable area is the engine room.
  • Cockpit ; is from where the boat is maneuvered; it is to here that all halyards, sheets, etc. go. The cockpit contains navigation and steering equipment and is from where the sails, rudder, and engine are controlled.
  • Deck; is the top part(roof) of a catamaran covering the hulls and bridge deck. The deck is made hard enough to walk on. To the deck, attaches lifelines and other equipment.
  • Sugarscoops ; are the aftmost part that gets their name from their scoop-shaped appearance; this is where the deck/cockpit meets that water and usually encompasses a stair or ladder for easy access depending on the size of the boat.
  • Cabin; is basically any area on the inside of the boat that is protected from the weather and is made to offer the crew space to rest, eat, and hangout. Inside the cabin, you will find berths (beds), a galley (kitchen), and sometimes specialized areas for repairs or storage.
  • Bridgedeck; connects the two hulls; the inside is the cabin, the top part is the deck, and the entire unit is called the bridge deck. Bridge deck clearance, the bridge deck’s height above the water, is an important factor on a catamaran since a too small clearance will create excess noise and vibrations and fatigue not only the crew but also the boat.

Main areas on a catamaran

Bow (front).

Nothing complicated here; the bow is just a nautical term for the foremost part of your boat. This is where the waves and the sea first meet the hull and depending on the type of boat, the bow(s) can be shaped differently.

Center (Middle)

The part between the bow and the stern is rarely called the center part( middle) of a boat; more common is to speak about the specific area situated within the middle part of the vessel, such as the cabin or the mast.

  • Cockpit; as mentioned above, here you will (usually) find everything that you need to maneuver and navigate the boat, such as a compass, GPS, sheets, steering wheel, and throttles for the engines. Some boats may not be set up this way and require you to move around the boat to access certain controls.

Cabin (inside of the boat)

The boat’s interior is where you will find everything that is made for the crew’s enjoyment; it is a place to eat, sleep, rest up, and hide away from nasty weather.

  • Berths; is a bed; sailors need to sleep too!
  • Galley ; is another name for kitchen, usually set up in a very primitive way with a gas stove on a stabilized platform to ensure your food won’t get tossed around.
  • Navstation; or navigation station, is a place, usually with a table, chair, and equipment for planning and logging a journey.

Stern (Back)

Stern is the name for the rearmost part of the boat; there is no clear definition as to where the stern stops and other parts begin, so it is something that the crew will have to figure out on their own through good communication.

Communicating directions on a sailboat

Not only will you have to know the different names of different areas on the boat, but it will also be essential to communicate clearly in what direction something is happening, for example, in a situation where you, the captain, want the crew to observe in a specific direction or pick up a piece of gear somewhere on the boat.

Communication on a sailboat is vital when you want to sail safely and efficiently; here, I have listed the words or phrases used to communicate a direction.

  • Forward; easy as it sounds, it is the same direction as where the bows are pointing. When giving directions towards or beyond the bow, you will use the word “forward” for example; the fender is located forward of the mast.
  • Aft ; is the behind the boat. When you are giving directions towards the stern, you will use the word “aft”; for example, the cockpit is located aft of the mast.
  • Port ; this will be your left side. Fun fact, in the good old days, you would always dock with the port on your left side; hence port is the left side. If you ever forget which one is which, “port” has 4 letters and so has the word”left”!
  • Starboard ; is your right side!

Types of sails

Sails come in very different shapes and sizes and are a science in itself; in this article, I will focus on the mainsail and three common types of staysail.

  • Mainsail; is, per definition, the sail attached to the mast; its sideways movements are controlled by the boom. When the mainsail is triangular in shape, as on most modern sailboats, it is called a Bermuda rig. Most mainsail uses something called battens.
  • Staysail; mainly comes in two versions, a staysail that does not overlap the mainsail is called a jib. A staysail that is larger and thus overlaps the mainsail is called a genoa.
  • Spinnaker ; is a big balloon-like sail that replaces the jib when sailing downwind.

Parts of a sail

  • Luff; the front part of the sail, is connected to the mast through a rail system which makes it possible to hoist or reef.
  • Leech; the back part of the sail.
  • Foot; the bottom part that reaches from the clew to the tack.
  • Clew; back bottom corner.
  • Tack; is the front bottom corner (remember “tacking”?).
  • Head; is the top triangle of the sail and this is where the mainsail halyard attaches.
  • Battens; are pieces of flexible material sewn into the mainsail to increase its aerodynamic shape. Battens can be full length or partial length.

Standing rigging

Everything that keeps the sails and mast upright are parts of the standing rigging; it is comprised of wires, cables, and lightweight metal structures.

  • Forestay; usually a metal wire running from the top of the mast to the bow, is sometimes combined with an inner forestay that connects to the mast at a lower point. If the forestay attaches to the top of the mast, the setup is called a masthead rig; if it attaches lower, it is called a fractional rig.
  • Backstay ; same as the forestay but attaches to the stern; most catamarans do not employ a backstay system but instead moves the side stays aft.
  • Shroud ; much like the forestay but stabilizes the mast sideways and runs from the top to the port or starboard side. Spreaders are used to change the angle of the wire against the mast and better support the mast.
  • Sidestay ; connects to the mast below the shrouds and is not pushed outwards with spreaders. On a catamaran, these attach aft of the mast to eliminate the need for a backstay; this makes it possible for a fully battened mainsail with a large roach.
  • Jumpers; are used on a fractional rig with diamond shrouds to add structural integrity to the mast without adding excess weight.
  • Bowsprit; is a pole amidship at the bow that allows for separation of the tacks (foremost, lower part of the sail) for increasing sail efficiency when using two headsails.

Other stabilizing parts

  • Spreaders; act to lessen the angle between the shrouds and the mast; a wider angle will result in forces acting sideways (stabilizing) instead of up and down (bending). This increases stability and decreases the risk of unwanted bending of the mast.

Running rigging

The running rigging on a catamaran is any piece of equipment used to control the shape of the sails, including what is needed to raise them.

  • Sheet; are the ropes (or wire, cables, etc.) that connect to the clew of a sail; on a catamaran, it connects to the staysail (genoa or jib, depending on the shape).
  • Mainsheet ; is the rope that makes it possible to change the mainsail’s angle; the mainsail can only move in a port to starboard direction(right and left) and not up and down.
  • Staysail sheet ; is called after whatever type of sail it is connected to, i.e., jib sheet or genoa sheet. Worth notice is that since the staysail operates on both sides of the catamaran (depending on if your tacking or gybing), it is connected with two ropes, one for the port side and one for the starboard side.
  • Halyards ; are the ropes that connect to the top of a sail and make hoisting (or raising) possible. Halyards have different names depending on what sail they are raising, such as Mainsail halyard or jib halyard. Not to be confused with sheets that act upon the sail once they are already hoisted. If the staysail is using a roller furling, then “hosting” is done differently.
  • Furling line; is used together with a roller furling and makes it possible to spool up the sail on the forestay instead of raising and lowering. This makes for a faster and easier way to reduce sail area.
  • Reefing lines; reefing is when you lower parts of your sail to reduce the sail area and reduce the boat’s power and speed; reefing lines are put through holes in the mainsail and attach to the boom.
  • Boom vang; is connected between the boom and deck; it is used to change the mainsail’s shape by pulling downward on the boom. (not very common on Catamarans)

In this category, we will look at the hulls and some of the vital parts that attach to them under the waterline.

  • Hulls; differ in their shapes depending on the boat’s purpose, a racing cat would have narrower hulls to reduce drag, and a cruising cat wider hulls to encompass more storage.
  • Rudder; is what changes the direction of the boat. When water passes around the rudders(two on a catamaran), it creates a “pushing force” that makes the boat turn. The rudder is connected to a steering wheel or a tiller at the cockpit through chains and linkage.
  • Centerboard and daggerboards ; are sorts of keels that can be raised or lowered to attain certain sailing characteristics. When the keel is up, drag is lower, and so is the draft (how deep the boat sticks in the water). A small draft makes it possible to travel in very shallow waters. The difference between a daggerboard and a centerboard is that a centerboard swivels into place, and a daggerboard is pulled straight up.
  • Mini-keel; is just what it sounds like; it is a keel but very small (a few inches deep) and has no ballast.
  • Crossbeam ; is a multihull-only feature and keeps the two hulls from moving in relation to each other. If the crossbeam is damaged or nonexistent, the bridge deck is the only thing that keeps the hulls in place. This will increase wear and sooner or later lead to cracks, or even worse, separation of hull and bridge deck.

Most catamarans have two engines, one on each hull aft the stern; usually, they are internal with only the propeller in the water. The other option, which is cheaper and most often found on smaller boats, is to have one outboard engine placed amidship (middle).

  • Inboard ; engines are situated in a compartment inside the boat at the stern. On an inboard engine, the propeller and the shaft are the only parts outside the hull. Sometimes the prop shaft (propeller shaft) is replaced by a sail drive.
  • Outboard ; is a standalone engine usually mounted on the bridge deck amidship(if only one is used) or mounted at the sterns when used in pairs. They are linked together with pushing rods and wires so it can be manipulated from the cockpit.
  • Saildrive ; is a type of gearbox that is quieter and vibrates less than a regular propeller and shaft setup.
  • Propeller and shaft; are the most common and cheapest way to propel your boat. It is basically just a watertight axel that sticks out of the hull, and at the end of it, you’ll find the propeller.

There are so many pieces of gear aboard a catamaran that an all-encompassing article would probably fill up the entire internet. Below I have listed the most common equipment that you will most likely encounter on any sailboat.

  • Winches; makes handling lines and ropes much easier. Instead of pulling them with your bare hands, you loop them around your winch and use the handle to crank. Winches come in mechanical style or electrical style.
  • Anchors ; is basically just a big hook made to stick to the bottom of the sea. Anchors have different shapes and weights depending not only on the seabed but also on the boat’s weight and size.
  • Navigation ; compass, GPS, and maps are all vital pieces of equipment making your trip safe.
  • Cleats ; is any equipment that is made to fasten a rope. Cleats come in different configurations; jam, cam, rope clutch, or the most common horn cleat.
  • Block ; is a device that can be used in pairs as a pulley (to reduce the force needed to lift something) or on its own to reduce the friction of a rope when the rope can not be drawn in a straight line.

Sailing is a popular sport in coastal towns and areas that are located on large bodies of water. It’s an excellent sport that allows you to harness the wind to power your vessel. Learn the basics with some handy sailing tips and instructions for beginners. Both novice and experienced boaters alike can benefit from a quick review of these beginner sailing basics!

Learning the Basics

Step 1 Learn the parts of a boat.

  • Stern refers to the back of the ship.
  • Bow refers to the front of the ship.
  • Port is the left-hand side of the boat when you are facing the bow (front).
  • Starboard is the right-hand side of the boat when you are facing the bow.

Step 2 Acquaint yourself with basic maneuvers.

  • Tacking refers to a sailing maneuver in which the sailor(s) turn the bow of the boat through the wind. The wind will change from one side of the vessel to the other side.
  • Jibing refers to a sailing maneuver in which you turn the boat so the bow faces away from the wind. Jibing is not as common as tacking since it can be much harder to do correctly. [4] X Research source

Step 3 Practice avoiding the boom.

Dressing for Safety

Step 1 Wear the proper clothes.

  • It’s best to wear closed-toe shoes for your own safety.
  • You can buy shirts with sun protection built into them. These are often sold at sportswear stores or can be found online.
  • If you are crewing a boat or sailing your own small vessel, wear clothes that can get wet, such as spandex or Lycra. These are usually materials used in swimwear. There are also websites that specialize in selling sailing gear, such as SailingWorld.com.

Step 2 Wear a lifejacket at all times.

Practicing on the Water

Step 1 Take a sailing course.

  • It is usually not possible to begin sailing without a course, as most sailing centers won’t allow you to take out their vessels without either taking a course from them or demonstrating your sailing knowledge.

Step 2 Tell someone before going out on the water.

  • Even if you are going to meet your sailing instructor, notify a third party of your plans.

Step 3 Choose calm, uncrowded waters.

There’s hardly a better way to absorb Moscow’s atmosphere than on a ship sailing up and down the Moskva River. While complicated ticketing, loud music and chilling winds might dampen the anticipated fun, this checklist will help you to enjoy the scenic views and not fall into common tourist traps.

How to find the right boat?

There are plenty of boats and selecting the right one might be challenging. The size of the boat should be your main criteria.

Plenty of small boats cruise the Moskva River, and the most vivid one is this yellow Lay’s-branded boat. Everyone who has ever visited Moscow probably has seen it.

This option might leave a passenger disembarking partially deaf as the merciless Russian pop music blasts onboard. A free spirit, however, will find partying on such a vessel to be an unforgettable and authentic experience that’s almost a metaphor for life in modern Russia: too loud, and sometimes too welcoming. Tickets start at $13 (800 rubles) per person.

Bigger boats offer smoother sailing and tend to attract foreign visitors because of their distinct Soviet aura. Indeed, many of the older vessels must have seen better days. They are still afloat, however, and getting aboard is a unique ‘cultural’ experience. Sometimes the crew might offer lunch or dinner to passengers, but this option must be purchased with the ticket. Here is one such  option  offering dinner for $24 (1,490 rubles).

If you want to travel in style, consider Flotilla Radisson. These large, modern vessels are quite posh, with a cozy restaurant and an attentive crew at your service. Even though the selection of wines and food is modest, these vessels are still much better than other boats.

Surprisingly, the luxurious boats are priced rather modestly, and a single ticket goes for $17-$32 (1,100-2,000 rubles); also expect a reasonable restaurant bill on top.

How to buy tickets?

Women holding photos of ships promise huge discounts to “the young and beautiful,” and give personal invitations for river tours. They sound and look nice, but there’s a small catch: their ticket prices are usually more than those purchased online.

“We bought tickets from street hawkers for 900 rubles each, only to later discover that the other passengers bought their tickets twice as cheap!”  wrote  (in Russian) a disappointed Rostislav on a travel company website.

Nevertheless, buying from street hawkers has one considerable advantage: they personally escort you to the vessel so that you don’t waste time looking for the boat on your own.

Prices start at $13 (800 rubles) for one ride, and for an additional $6.5 (400 rubles) you can purchase an unlimited number of tours on the same boat on any given day.

Flotilla Radisson has official ticket offices at Gorky Park and Hotel Ukraine, but they’re often sold out.

Buying online is an option that might save some cash. Websites such as  this   offer considerable discounts for tickets sold online. On a busy Friday night an online purchase might be the only chance to get a ticket on a Flotilla Radisson boat.

This  website  (in Russian) offers multiple options for short river cruises in and around the city center, including offbeat options such as ‘disco cruises’ and ‘children cruises.’ This other  website  sells tickets online, but doesn’t have an English version. The interface is intuitive, however.

Buying tickets online has its bad points, however. The most common is confusing which pier you should go to and missing your river tour.

“I once bought tickets online to save with the discount that the website offered,” said Igor Shvarkin from Moscow. “The pier was initially marked as ‘Park Kultury,’ but when I arrived it wasn’t easy to find my boat because there were too many there. My guests had to walk a considerable distance before I finally found the vessel that accepted my tickets purchased online,” said the man.

There are two main boarding piers in the city center:  Hotel Ukraine  and  Park Kultury . Always take note of your particular berth when buying tickets online.

Where to sit onboard?

Even on a warm day, the headwind might be chilly for passengers on deck. Make sure you have warm clothes, or that the crew has blankets ready upon request.

The glass-encased hold makes the tour much more comfortable, but not at the expense of having an enjoyable experience.

Getting off the boat requires preparation as well. Ideally, you should be able to disembark on any pier along the way. In reality, passengers never know where the boat’s captain will make the next stop. Street hawkers often tell passengers in advance where they’ll be able to disembark. If you buy tickets online then you’ll have to research it yourself.

There’s a chance that the captain won’t make any stops at all and will take you back to where the tour began, which is the case with Flotilla Radisson. The safest option is to automatically expect that you’ll return to the pier where you started.

“That sure sounds bad, doesn’t it?” Kagan replied later.

The Democratic appointees on the bench sought to illustrate the inherent absurdity of this argument with other scenarios as well—Kagan got Sauer to admit that the president could share nuclear secrets, while Justice Sonia Sotomayor presented a scenario in which a president orders the military to assassinate a political rival. Sauer said that might qualify as an official act too. It was the only way to maintain the logic of his argument, which is that Trump is above the law.

“Trying to overthrow the Constitution and subvert the peaceful transfer of power is not an official act, even if you conspire with other government employees to do it and you make phone calls from the Oval Office,” Michael Waldman, a legal expert at the Brennan Center for Justice, a liberal public-policy organization, told me.

Trump’s legal argument is a path to dictatorship. That is not an exaggeration: His legal theory is that presidents are entitled to absolute immunity for official acts. Under this theory, a sitting president could violate the law with impunity, whether that is serving unlimited terms or assassinating any potential political opponents, unless the Senate impeaches and convicts the president. Yet a legislature would be strongly disinclined to impeach, much less convict, a president who could murder all of them with total immunity because he did so as an official act. The same scenario applies to the Supreme Court, which would probably not rule against a chief executive who could assassinate them and get away with it.

The conservative justices have, over the years, seen harbingers of tyranny in union organizing , environmental regulations , civil-rights laws , and universal-health-care plans . When confronted with a legal theory that establishes actual tyranny, they were simply intrigued. As long as Donald Trump is the standard-bearer for the Republicans, every institution they control will contort itself in his image in an effort to protect him.

The Supreme Court, however, does not need to accept Trump’s absurdly broad claim of immunity for him to prevail in his broader legal battle. Such a ruling might damage the image of the Court, which has already been battered by a parade of hard-right ideological rulings. But if Trump can prevail in November, delay is as good as immunity. The former president’s best chance at defeating the federal criminal charges against him is to win the election and then order the Justice Department to dump the cases. The Court could superficially rule against Trump’s immunity claim, but stall things enough to give him that more fundamental victory.

If they wanted, the justices could rule expeditiously as well as narrowly , focusing on the central claim in the case and rejecting the argument that former presidents have absolute immunity for acts committed as president, without getting into which acts might qualify as official or not. Sauer also acknowledged under questioning by Justice Amy Coney Barrett that some of the allegations against Trump do not involve official acts but private ones, and so theoretically the prosecution could move ahead with those charges and not others. But that wouldn’t necessarily delay the trial sufficiently for Trump’s purposes.

“On big cases, it’s entirely appropriate for the Supreme Court to really limit what they are doing to the facts of the case in front of it, rather than needing to take the time to write an epic poem on the limits of presidential immunity,” Waldman said. “If they write a grant opinion, saying no president is above the law, but it comes out too late in the year, they will have effectively immunized Trump from prosecution before the election while pretending not to.”

Trump’s own attorneys argued in 2021, during his second impeachment trial, that the fact that he could be criminally prosecuted later was a reason not to impeach him. As The New York Times reported , Trump’s attorney Bruce Castor told Congress that “after he is out of office,” then “you go and arrest him.” Trump was acquitted in the Senate for his attempted coup after only a few Republicans voted for conviction; some of those who voted to acquit did so reasoning that Trump was subject to criminal prosecution as a private citizen. The catch-22 here reveals that the actual position being taken is that the president is a king, or that he is entitled to make himself one. At least if his name is Donald Trump.

Democracy relies on the rule of law and the consent of the governed—neither of which is possible in a system where the president can commit crimes or order them committed if he feels like it. “We can’t possibly have an executive branch that is cloaked in immunity and still expect them to act in the best interests of the people in a functioning democracy,” Praveen Fernandes, the vice president of the Constitutional Accountability Center, a liberal legal organization, told me.

The only part of Trump’s case that contains anything resembling a reasonable argument is the idea that without some kind of immunity for official acts, presidents could be prosecuted on a flimsy basis by political rivals. But this argument is stretched beyond credibility when it comes to what Trump did, which was to try repeatedly and in multiple ways to unlawfully seize power after losing an election. Even if the prospect of presidents being prosecuted for official acts could undermine the peaceful transfer of power, actually trying to prevent the peaceful transfer of power is a much more direct threat—especially because it has already happened. But the Republican-appointed justices seemed much more concerned about the hypothetical than the reality.

“If an incumbent who loses a very close, hotly contested election knows that a real possibility after leaving office is not that the president is going to be able to go off into a peaceful retirement but that the president may be criminally prosecuted by a bitter political opponent,” Justice Samuel Alito asked, “will that not lead us into a cycle that destabilizes the functioning of our country as a democracy?”

Trump has the conservative justices arguing that you cannot prosecute a former president for trying to overthrow the country, because then they might try to overthrow the country, something Trump already attempted and is demanding immunity for doing. The incentive for an incumbent to execute a coup is simply much greater if the Supreme Court decides that the incumbent cannot be held accountable if he fails. And not just a coup, but any kind of brazen criminal behavior. “The Framers did not put an immunity clause into the Constitution. They knew how to,” Kagan pointed out during oral arguments. “And, you know, not so surprising, they were reacting against a monarch who claimed to be above the law. Wasn’t the whole point that the president was not a monarch and the president was not supposed to be above the law?”

At least a few of the right-wing justices seemed inclined to if not accept Trump’s immunity claim, then delay the trial, which would likely improve his reelection prospects. As with the Colorado ballot-access case earlier this year, in which the justices prevented Trump from being thrown off the ballot in accordance with the Constitution’s ban on insurrectionists holding office , the justices’ positions rest on a denial of the singularity of Trump’s actions.

No previous president has sought to overthrow the Constitution by staying in power after losing an election. Trump is the only one, which is why these questions are being raised now. Pretending that these matters concern the powers of the presidency more broadly is merely the path the justices sympathetic to Trump have chosen to take in order to rationalize protecting the man they would prefer to be the next president. What the justices—and other Republican loyalists—are loath to acknowledge is that Trump is not being uniquely persecuted; he is uniquely criminal.

This case—even more than the Colorado ballot-eligibility case—unites the right-wing justices’ political and ideological interests with Trump’s own. One way or another, they will have to choose between Trumpism and democracy. They’ve given the public little reason to believe that they will choose any differently than the majority of their colleagues in the Republican Party.

The Last Thing This Supreme Court Could Do to Shock Us

There will be no more self-soothing after this..

For three long years, Supreme Court watchers mollified themselves (and others) with vague promises that when the rubber hit the road, even the ultraconservative Federalist Society justices of the Roberts court would put democracy before party whenever they were finally confronted with the legal effort to hold Donald Trump accountable for Jan. 6. There were promising signs: They had, after all, refused to wade into the Trumpian efforts to set aside the election results in 2020. They had, after all, hewed to a kind of sanity in batting away Trumpist claims about presidential records (with the lone exception of Clarence Thomas, too long marinated in the Ginni-scented Kool-Aid to be capable of surprising us, but he was just one vote). We promised ourselves that there would be cool heads and grand bargains and that even though the court might sometimes help Trump in small ways, it would privilege the country in the end. We kept thinking that at least for Justices Brett Kavanaugh and Neil Gorsuch and Chief Justice John Roberts , the voice of reasoned never-Trumpers might still penetrate the Fox News fog. We told ourselves that at least six justices, and maybe even seven, of the most MAGA-friendly court in history would still want to ensure that this November’s elections would not be the last in history. Political hacks they may be, but they were not lawless ones.

On Thursday, during oral arguments in Trump v. United States , the Republican-appointed justices shattered those illusions. This was the case we had been waiting for, and all was made clear—brutally so. These justices donned the attitude of cynical partisans, repeatedly lending legitimacy to the former president’s outrageous claims of immunity from criminal prosecution. To at least five of the conservatives, the real threat to democracy wasn’t Trump’s attempt to overturn the election—but the Justice Department’s efforts to prosecute him for the act. These justices fear that it is Trump’s prosecution for election subversion that will “destabilize” democracy, requiring them to read a brand-new principle of presidential immunity into a Constitution that guarantees nothing of the sort. They evinced virtually no concern for our ability to continue holding free and fair elections that culminate in a peaceful transfer of power. They instead offered endless solicitude for the former president who fought that transfer of power.

However the court disposes of Trump v. U.S. , the result will almost certainly be precisely what the former president craves: more delays, more hearings, more appeals—more of everything but justice . This was not a legitimate claim from the start, but a wild attempt by Trump’s attorneys to use his former role as chief executive of the United States to shield himself from the consequences of trying to turn the presidency into a dictatorship. After so much speculation that these reasonable, rational jurists would surely dispose of this ridiculous case quickly and easily, Thursday delivered a morass of bad-faith hand-wringing on the right about the apparently unbearable possibility that a president might no longer be allowed to wield his powers of office in pursuit of illegal ends. Just as bad, we heard a constant minimization of Jan. 6, for the second week in a row , as if the insurrection were ancient history, and history that has since been dramatically overblown, presumably for Democrats’ partisan aims.

We got an early taste of this minimization in Trump v. Anderson , the Colorado case about removing Trump from the ballot. The court didn’t have the stomach to discuss the violence at the Capitol in its sharply divided decision, which found for Trump ; indeed, the majority barely mentioned the events of Jan. 6 at all when rejecting Colorado’s effort to bar from the ballot an insurrectionist who tried to steal our democracy. But we let that one be, because we figured special counsel Jack Smith would ride to the rescue. Smith has indicted Trump on election subversion charges related to Jan. 6, and the biggest obstacle standing between the special counsel and a trial has been the former president’s outlandish claim that he has absolute immunity from criminal charges as a result of his having been president at the time. Specifically, Trump alleges that his crusade to overturn the election constituted “official acts” that are immune from criminal liability under a heretofore unknown constitutional principle that the chief executive is quite literally above the law.

The U.S. Court of Appeals for the District of Columbia Circuit held in February that the president does not have blanket or absolute immunity for all actions taken in office, including “official” acts performed under the guise of executing the law (for example, Trump’s attempt to weaponize the DOJ against election results under the pretense of investigating fraud). The D.C. Circuit’s emphatic, cross-ideological decision should have been summarily affirmed by SCOTUS within days. Instead, the justices set it for arguments two months down the road—a bad omen, to put it mildly . Even then, many court watchers held out hope that Thursday morning’s oral arguments were to be the moment for the nine justices of the Supreme Court to finally indicate their readiness to take on Trump, Trumpism, illiberalism, and slouching fascism.

It was not to be. Justice Samuel Alito best captured the spirit of arguments when he asked gravely “what is required for the functioning of a stable democratic society” (good start!), then answered his own question: total immunity for criminal presidents (oh, dear). Indeed, anything but immunity would, he suggested, encourage presidents to commit more crimes to stay in office: “Now, if an incumbent who loses a very close, hotly contested election knows that a real possibility after leaving office is not that the president is going to be able to go off into a peaceful retirement but that the president may be criminally prosecuted by a bitter political opponent, will that not lead us into a cycle that destabilizes the functioning of our country as a democracy?” Never mind that the president in question did not leave office peacefully and is not sitting quietly in retirement but is instead running for presidential office once again. No, if we want criminal presidents to leave office when they lose, we have to let them commit crimes scot-free. If ever a better articulation of the legal principle “Don’t make me hit you again” has been proffered at an oral argument, it’s hard to imagine it.

Justice Sonia Sotomayor spoke to this absurdity when she responded in what could only be heard as a cri de coeur: “Stable democratic society needs good faith of public officials,” she said. “That good faith assumes that they will follow the law.” The justice noted that despite all the protections in place, a democracy can sometimes “potentially fail.” She concluded: “In the end, if it fails completely, it’s because we destroyed our democracy on our own, isn’t it?”

But it was probably too late to make this plea, because by that point we had heard both Alito and Gorsuch opine that presidents must be protected at all costs from the whims of overzealous deep state prosecutors brandishing “vague” criminal statutes. We heard Kavanaugh opine mindlessly on the independent counsel statute and how mean it is to presidents, reading extensively from Justice Antonin Scalia’s dissent in a case arguing that independent counsels are unconstitutional. (Yes, Kavanaugh worked for Ken Starr , the independent counsel.) If you’re clocking a trend here, it’s gender. Just as was the case in Anderson , it’s the women justices doing the second-shift work here: both probing the thorny constitutional and criminal questions and signaling a refusal to tank democracy over abstractions and deflections. As was the case in the EMTALA arguments, it’s the women who understand what it looks like to cheat death.

Is the president, Sotomayor asked, immune from prosecution if he orders the military to assassinate a political rival? Yes, said John Sauer, who represented Trump—though it “depends on the circumstances.” Could the president, Justice Elena Kagan asked, order the military to stage a coup? Yes, Sauer said again, depending on the circumstances. To which Kagan tartly replied that Sauer’s insistence on specifying the “circumstances” boiled down to “Under my test, it’s an official act, but that sure sounds bad, doesn’t it?” (Cue polite laughter in the chamber.)

This shameless, maximalist approach should have drawn anger from the conservative justices—indignation, at least, that Sauer took them for such easy marks. But it turns out that he calibrated his terrible arguments just right. The cynicism on display was truly breathtaking: Alito winkingly implied to Michael Dreeben, representing Smith, that we all know that Justice Department lawyers are political hacks, right? Roberts mocked Dreeben for saying “There’s no reason to worry because the prosecutor will act in good faith.”

The conservative justices are so in love with their own voices and so convinced of their own rectitude that they monologued about how improper it was for Dreeben to keep talking about the facts of this case, as opposed to the “abstract” principles at play. “I’m talking about the future!” Kavanaugh declared at one point to Dreeben, pitching himself not as Trump’s human shield but as a principled defender of the treasured constitutional right of all presidents to do crime. (We’re sure whatever rule he cooks up will apply equally to Democratic presidents, right?) Kavanaugh eventually landed on the proposition that prosecutors may charge presidents only under criminal statutes that explicitly state they can be applied to the president. Which, as Sotomayor pointed out, would mean no charges everywhere, because just a tiny handful of statutes are stamped with the label “CAN BE APPLIED TO PRESIDENT.”

The words bold and fearless action were repeated on a loop today, as a kind of mantra of how effective presidents must be free to act quickly and decisively to save democracy from the many unanticipated threats it faces. And yet the court—which has been asked to take bold and fearless action to deter the person who called Georgia’s secretary of state to demand that he alter the vote count, and threatened to fire DOJ officials who would not help steal an election—is backing away from its own duty. The prospect of a criminal trial for a criminal president shocked and appalled five men: Thomas, Alito, Kavanaugh, and Gorsuch suggested that Smith’s entire prosecution is unconstitutional; meanwhile, Roberts sounded eager at times to handle the case just a hair more gracefully: by cutting out its heart by preventing the jury from hearing about “official acts” (which lie at the center of the alleged conspiracy). Justice Amy Coney Barrett was far more measured, teasing out a compromise with Dreeben that would compel the trial court to tell the jury it could not impose criminal liability for these “official” acts, only “private ones.” Remember, drawing that line would require months of hearings and appeals, pushing any trial into 2025 or beyond. The president who tried to steal the most recent election is running in the next one, which is happening in mere months.

The liberal justices tried their best to make the case that justice required denying Trump’s sweeping immunity claim, permitting the trial to move forward, and sorting out lingering constitutional issues afterward, as virtually all other criminal defendants must do. They got little traction. Everyone on that bench was well aware that the entire nation was listening to arguments; that the whole nation wants to understand whether Trump’s refusal to concede the 2020 election was an existential threat to democracy or a lark. Five justices sent the message, loud and clear, that they are far more worried about Trump’s prosecution at the hands of the deep-state DOJ than about his alleged crimes, which were barely mentioned. This trial will almost certainly face yet more delays. These delays might mean that its subject could win back the presidency in the meantime and render the trial moot. But the court has now signaled that nothing he did was all that serious and that the danger he may pose is not worth reining in. The real threats they see are the ones Trump himself shouts from the rooftops: witch hunts and partisan Biden prosecutors. These men have picked their team. The rest hardly matters.

Opinion Amy Coney Barrett is no handmaid to the Supreme Court’s conservative majority

Benchmarked against her conservative colleagues, Justice Barrett has been a pleasant surprise.

Justice Amy Coney Barrett is turning out to be the most intriguing — and to some extent, surprising — of the nine Supreme Court justices.

Now in her fourth term on the bench, Barrett is certainly no liberal. As expected, she voted to eliminate the constitutional right to abortion . That was not a one-off; Barrett has also joined majorities to dramatically expand gun rights, limit affirmative action and curtail the power of regulatory agencies.

Nor is she in danger of disappointing conservatives in the mode of a Harry A. Blackmun, John Paul Stevens or David Souter, Republican nominees who turned out to be reliable liberal votes. She’s not even a Sandra Day O’Connor or Anthony M. Kennedy, swing justices who voted with liberals on key occasions.

Still, benchmarking Barrett against her conservative colleagues — and against expectations at the time she was confirmed — she has been what passes for a pleasant surprise since being named to replace Justice Ruth Bader Ginsburg in 2020. Barrett’s long-standing ties to a conservative Catholic group, People of Praise, raised warnings that she would be an eager handmaid to the conservative male majority; in reality, Barrett has been no submissive pushover.

And despite academic writings that suggested Barrett would not hesitate to overturn constitutional law precedents with which she disagreed, her judicial opinions have shown her to be more cautious technocrat than ideological fence-swinger.

She has emerged as a member of what amounts to the more moderate wing, along with Chief Justice John G. Roberts Jr. and Justice Brett M. Kavanaugh. One common measure of the justices’ ideologies showed Barrett initially as conservative as, or even more conservative than, fellow Donald Trump nominee Neil M. Gorsuch; more recently, she has been edging closer to Kavanaugh, and it’s not impossible to imagine them swapping places this term.

One early example: In a 2021 case involving a Catholic foster care agency that wouldn’t place children with same-sex couples, Barrett balked at voting to overturn a religious freedom decision reviled by conservatives, saying there was “no reason to decide in this case whether [the precedent] should be overruled, much less what should replace it.”

Last year, in a case challenging the Indian Child Welfare Act as an unconstitutional infringement on states’ rights, Barrett methodically eviscerated Texas’s arguments against the law — and, notably, declined to address the question of whether the law’s preference for keeping Indian children with Indian families represented a violation of the Constitution’s equal protection clause.

In a thoughtful concurring opinion in the Biden student loan case , Barrett grappled with the liberal justices’ arguments that the conservative majority’s newly announced “major questions” doctrine limiting the power of federal agencies in the absence of clear congressional authorization was at odds with its professed commitment to textualism. She acknowledged that some broad articulations of the doctrine should give “pause” to an “honest textualist.”

This term in particular has featured something of a declaration of independence for Barrett. Last month, in the 14th Amendment ballot disqualification case involving Trump, Barrett agreed that Colorado couldn’t remove the former president from the GOP primary ballot but said her conservative colleagues had gone too far in ruling — unnecessarily, in Barrett’s view — that federal legislation was necessary to enforce Section 3.

Last week, Barrett offered a decidedly different take than her fellow conservatives as the court heard oral arguments in another Trump case , this one about his assertion of absolute presidential immunity from prosecution for his official acts, and in an abortion case about whether a federal law requiring emergency “stabilizing” care for pregnant women preempts an Idaho law that criminalizes abortion except to save the life of the mother.

Some justices lob softballs at lawyers whose positions they may sympathize with; Barrett relentlessly drilled the lawyers representing Trump and Idaho about the contours of their arguments. “I’m kind of shocked, actually,” she told Idaho lawyer Joshua Turner when he seemed to be backing away from a point the state had already conceded. “You are hedging.”

In the immunity case, Barrett tag-teamed with Justice Elena Kagan to obtain potentially significant concessions from Trump attorney D. John Sauer about actions Trump took as president that Sauer acknowledged could still be prosecuted because they constituted private acts. Barrett expressed incredulity at Sauer’s claim that the constitutional remedy of impeachment means that a president can only be criminally convicted if he is first impeached and removed from office.

“There are many other people who are subject to impeachment, including the nine sitting on this bench, and I don’t think anyone has ever suggested that impeachment would have to be the gateway to criminal prosecution for any of the many other officers subject to impeachment,” Barrett said. “So why is the president different when the impeachment clause doesn’t say so?”

Then she went in for the kill. Sauer was also arguing that a general criminal law can’t be invoked against a president unless it expressly covers him. “So how can you say,” Barrett countered, “that he would be subject to prosecution after impeachment while at the same time saying that he’s exempt from these criminal statutes?”

Well, Sauer said, some laws do explicitly mention the president.

“A few,” Barrett retorted . “Two or three.”

At which point she got to the outrageous get-out-of-jail-free essence of Sauer’s position.

“So just to pick up Justice Kagan’s example of a president who orders a coup, let’s imagine that he is impeached and convicted for ordering that coup,” she said. “You’re saying that he couldn’t be prosecuted for that, even after a conviction and impeachment proceeding, if there was not a statute that expressly referenced the president and made it criminal for the president?”

This in an argument where Justice Samuel A. Alito Jr. fretted over whether Franklin D. Roosevelt could have been prosecuted for interning Japanese Americans in the 1940s. In which Kavanaugh, as if this were a Federalist Society event, used his time to read extensively from Justice Antonin Scalia’s dissent in Morrison v. Olson , the 1988 case upholding the independent counsel statute. In which Gorsuch proclaimed, “We are writing a rule for the ages.”

By contrast, Barrett focused on the here and now, and seemed to be searching for narrow grounds, not deciding more than was required by the case at hand. That shouldn’t be saying much — but with this aggressive conservative majority, it is.

Broadway shows usually come with a back story about the yearslong slog it took to get them there. Not so with Heidi Schreck’s new translation of Chekhov’s “Uncle Vanya,” which arrived at Lincoln Center Theater’s Vivian Beaumont Theater not even 12 months after its inception.

Directed by Lila Neugebauer, it is Schreck’s first Broadway show since “ What the Constitution Means to Me ,” in 2019, and the ensemble is a starry one. Steve Carell is making his Broadway debut as Vanya, who believes he has wasted his life running a provincial estate and its farm alongside his niece, Sonia, played by Alison Pill, to support Sonia’s largely absentee father, portrayed by Alfred Molina .

William Jackson Harper, best known for “ The Good Place ,” plays Astrov, the eco-nerd doctor whom Sonia loves. Anika Noni Rose, a Tony Award winner for “Caroline, or Change,” is the glamorous Elena, Sonia’s stepmother, for whom both Vanya and Astrov yearn.

In mid-April, a week before the show’s opening on April 24, Schreck, Neugebauer, Carell, Harper, Pill and Rose gathered to talk over their dinner break in a room off the Beaumont lobby. These are edited excerpts from that conversation.

What was your relationship to “Uncle Vanya” and Chekhov before this show?

HEIDI SCHRECK I lived in Russia right out of college for two years. When I moved back to Seattle, I started this theater company with my husband, and there was this Russian company who would come and perform Russian plays. They invited me to be the translator. Basically I would do live interpretation.

ALISON PILL How do you mean live? You would stand in front —

SCHRECK Like I was the subtitles.

LILA NEUGEBAUER You’d talk simultaneously?

SCHRECK Yes.

WILLIAM JACKSON HARPER Whoa.

SCHRECK It felt like the goal was to not get in the way of the actor. So when Lila asked me about doing this, that was the lens I brought: How can I do this and not get in the way of the text?

NEUGEBAUER I’d last encountered the play maybe a decade ago and frankly remember not being particularly affected. The impetus to do this was that I reread it and was struck by a feeling of personalization so deep and surprising that I felt like, maybe I’ll take a crack, but I only want to take a crack if my friend will do it with me. I wanted to do a version of the play that felt like a Heidi Schreck play.

PILL I’d only done workshops, spending, you know, a few days on “The Seagull” or “The Cherry Orchard.” I was constantly struck by how difficult it is to make sense of.

What makes Chekhov so hard?

ANIKA NONI ROSE He says both a lot and nothing. When you’re creating your character, you’re constantly searching for the kernel of truth or life. You get to a point where you’re like, “Yeah, I get it.” And two days later you’re like, “What?” It’s a barrage of information, and yet you are bereft.

STEVE CARELL The more you discover, the more you realize you need to discover. It opens up in front of you, and it just keeps opening up. Every avenue you turn down. I think that’s the beauty of it. We were talking about one company in Russia that rehearsed for a full year before they performed it.

PILL Which makes perfect sense. He’s really specific about when people are laughing or crying, but that’s about [expletive] it.

Had any of you ever wanted to play these roles?

CARELL Nope.

HARPER I always found Chekhov really confounding. I’m more of a new-play guy, if anything. So I never really yearned to do Chekhov necessarily until [Lila and Heidi] were like, “Hey, you want to hang out and read this play?” And then something happened. Now I’m hyped. But at the time, I was just curious about what this could be with people that I find irreverent in the best way.

Steve, you haven’t done a play since 1995 ?

CARELL It’s been a while, yeah.

Why this one? Why now?

CARELL My kids are out of the house, so that’s part of it. That’s most of it. I didn’t want to leave for months on end while they were little. But I always harbored the desire to do a play at some point. This came out of the blue. I just decided it was time, and it would be fun and challenging. The most exciting part of any project that I’m a part of is that I want to be a part of an ensemble. This is that.

You and Alison played father and daughter in the 2007 movie “ Dan in Real Life .” Does that history help with Vanya and Sonia?

PILL I think so.

CARELL I think so, too.

PILL Vanya’s her dad, for all intents and purposes. There is a man whose DNA she has, but he’s not particularly great. In terms of day-to-day stuff, the way we’ve built it is just: This is her dad. [Steve has] known me since I was turning 21. That can only help inform the kind of closeness that Sonia and Vanya need to have.

Heidi, why was this the next thing in your career?

SCHRECK I, like many of us, had a pretty wild last five years. I gave birth; we had a pandemic. I said yes because of Lila and because of Chekhov. But when I went to actually do the work, I found it deeply calming after some fairly intense postpartum depression. I found spending time with this play and with these words and with this writer and with Lila in this moment to be a very healing thing.

Was there anything that you wanted to amplify, or rectify?

SCHRECK I felt no need to revise the play. I’m just really fascinated by the fact that the work Vanya has done his whole life is a very feminine, maternal kind of work. He’s raised a daughter. He’s made another man’s career possible. He’s done the labor that, historically, women do. My dad was very much a Mr. Mom kind of character. The work he did in my life was so meaningful. I get really sad that Vanya feels like he didn’t do anything because I feel like he really did.

NEUGEBAUER There’s a moment in the play where Steve says, Vanya says, “Here’s my life. Here’s my love. What do I do with it? Where do I put it?” I found myself thinking, well, here’s where you put it, with your daughter. And that’s what the end of the play is: He puts it here.

Anika, you have a beautiful moment when you’re alone onstage, with a little bit of music that’s not in the script. How did that happen?

ROSE I felt like something needed to be in that space. This woman [Elena] is a musician. She went to a conservatory. The song that I’m humming is “ Nature Boy ” by Nat King Cole. I think that even in that moment, she is subliminally thinking of this man [Astrov]. It is moving through her and coming out in music, the way music does move through you subliminally.

Steve and Will, when most people know you from comedy — and Chekhov is so tricky, blending comedy with sadness and despair — how do you manage audience expectations?

CARELL The characters don’t know if it’s a comedy or a drama. So you just proceed. Things are inadvertently funny all the time in the show, and a lot of the laughs were not ones that we necessarily knew we were going to get. Which I think is the best kind of laugh because we’re just in the scene and not anticipating anything as a laugh line or, conversely, as a dramatic line.

HARPER Honestly, that first preview was really surprising. I definitely felt that we kind of had a tiger by the tail a little bit. There were so many laughs that I’m like, did we mess up? Because I didn’t think anything was necessarily all that funny.

There have been a lot of productions of “Uncle Vanya” lately. What’s that about?

ROSE It’s about where we are in the world. [The characters are] talking about there having just been an epidemic. They’re talking about how we’re eating up the land. They’re talking about what have you done with your life? Have you lived, have you loved? Has life been worth it for you? Coming out of the pandemic — if you don’t have those questions, were you even awake?

PILL Chekhov was writing in this pre-revolutionary time where it felt like [expletive] was about to kick off, and it turns out it was. It feels like we are all waiting with bated breath for whatever to happen. There is this sort of feeling of like, is there going to be World War III? Legitimate question. It’s really [expletive] hard to get out of bed, and raise a child.

HARPER You could just stay awake like me. Everything you’re talking about is the stuff that actually keeps me up, and then wakes me up at five. It’s like, OK, what can I worry about now? World War III or, you know, “Why is it so warm right now?”

When they were doing Christopher Durang’s “Vanya and Sonia and Masha and Spike” here, he wrote in an essay that he loved “the emotional sadness in Chekhov.”

NEUGEBAUER [Chekhov is] full of every emotion under the sun.

PILL Sometimes within the same scene.

HARPER Within the same line, yeah.

SCHRECK That’s what’s so hard about it. You have to get in touch with all the grief and stuff that exists in the play, and then you have to do all the other things, too.

CARELL Some people will walk away [from the show] thinking, “That was really funny,” others not at all, but may be affected emotionally. I’m fascinated by the different reactions that we’re getting night to night. One night I came in with the flowers [for Elena] and it was like a circus. People went, “Whaaaaaaa!” It was such a vocal response. It almost made me laugh because I thought, that’s crazy. Other nights, it’s hushed, and you can hear a pin drop. You feel the tension in the room.

Does anything in the play continue to surprise you?

PILL What I am constantly struck by is the awareness of “This is another moment where things could have gone entirely differently.” I feel it every single night at the end of Act II, when [Sonia’s father] doesn’t say yes to [his wife] playing the piano. That moment to me is just a knife in the heart. I’m like, “Just say yes for once.”

ROSE I feel like it’s a pick-your-[own]-adventure story. If you came to this play nine times and followed a different person’s journey each time, you would get a different story each time. I know that sounds weird.

CARELL No, it doesn’t.

NEUGEBAUER It sounds like an ensemble play.

HARPER The thing that keeps striking me is the ways in which every character is doing their absolute best, and sometimes your best sucks . There’s something about seeing a bunch of really imperfect people doing their best and things falling apart anyway. I find some kind of poetry in that.
