This essay addresses three pertinent aspects— first , how the Second Judges’ and Third Judges’ Cases led to the establishment of the collegium system. In this discussion, the essay analyses the key findings of the Second and Third Judges’ Cases , an exercise which is pertinent for an understanding of how the ‘collegium’ came into being. Second , this essay proceeds to establish a normative vision of what the judicial appointments process should look like so as to address the criticisms that the collegium system has been subjected to. The essay makes a strong case for reform of the collegium through practical examples of when it has failed in its constitutional duties. Third , the essay addresses questions relating to how appointments should be made, and who should make the appointments.

An analysis of the appointment of judges and an overview to the collegium system has been made in this research paper. Furthermore, in relation to the Judges? appointment of SC and HC, all significant cases are evaluated. The Supreme Court struck down the National Judicial Appointment Commission (NJAC) and upheld the Collegiums System of the appointment of judges. India is the only country of the world where judges are appointed by themselves. In order to make the collegium System more transparent and democratic reforms are needed.

Over the past century, the Supreme Court of India has gradually evolved from being restraint to being activist. This shift in the attitude of the judges took off during the period of emergency in the mid 1970&#39;s. In an effort to curb executive dominance, the judiciary began to take it upon itself to expand its role in administering justice. In the pursuance of its activist role, the judiciary has often overstepped its boundaries and ventured into the business of the executive wing. This calls for serious questions regarding their independence and accountability. There has been a national debate raging in India about the system of appointments for Supreme Court and High Court judges. At the founding of the Indian Supreme Court, the executive had primary authority over judicial appointments. In 1993, the Supreme Court created a new system of appointments known as the collegium system, whereby the Chief Justice of India and senior judges of the Supreme Court make new appointments to the Supreme Court as well as the High Courts. In 2014, Parliament amended the Constitution and passed a bill to create a commission to appoint judges, but the Indian Supreme Court declared the law unconstitutional. In this article, we ascertain whether the nature of the appointments procedure impacts the biographical and other characteristics of the judges that are eventually selected. We do this by comparing the biographical characteristics of judges appointed by the executive-appointments system (prior to 1993), on the one hand, and the judges appointed by the collegium (on or after 1993) to the Supreme Court of India. We find that both the pre-collegium and the collegium system maintain the geographical and religious diversity of India in the candidates that are appointed. However, both have failed to account for gender diversity. In addition, the path to the Supreme Court appears to have narrowed – typically those who are appointed as judges by the collegium spend longer periods in private practice and on the bench than pre-collegium judges.

" India is the only country where judges select themselves, determine their own transfers and also discipline themselves "-K.P.S Gill, former DGP The National Judicial Appointments Commission is a constitutional body established to ensure transparency in the procedure of appointments of the judges of the Supreme Court and the High Courts. This was struck down by the Supreme Court in 2015, saying that it challenged the independence of judiciary. The judgement brought back the collegium system which indeed has no constitutional provision. The objective of this research is to analyse the importance of a separate body for appointments of judges in our country and why our judicial fraternity is still uncertain on the procedure of appointment of the judges. The research is based on secondary sources which included online data, books, articles and journals. The researchers have focused on the ongoing vociferous debate on NJAC and the Collegium System and the benefits of having a separate body for the judicial appointments.

The remark of the current law minister of India, Mr. Kiren Rijiju in Rajya Sabha recently that “a new system of appointment of judges in the higher judiciary is much needed as the prevalent collegium system is opaque and inefficient in filling the vacant posts of judges which has led to a huge pendency of cases”, further the remark of the Vice President India “that the striking down the National Judicial Appointment Act was a severe compromise of Parliamentary sovereignty and disregard of the mandate of people” highlights a true debate regarding fight of primacy in the appointment of judges in the higher judiciary. This debate boils down to the fact as to who should appoint the judges, should the primacy lie into the hands of the executive or the judiciary leading us to the question “Who is Superior” whether it is the executive or is it the judiciary, but the answer to it is not who is superior but why should superiority rest with respect to appointment of judges lie in the hands of judiciary. It is because the Indian Constitution follows the doctrine of separation of powers as propounded by Montesquie, its basic spirit is that executive, legislature and the judiciary are superior in their own sphere and no one should usurp upon the powers of another maintaining a system of checks and balances in the governance of the country. Hence the collegium system is responsible to appoint judges to the higher judiciary in India today.
