Judicial Assignments

The chief superior judge assigns a presiding judge to each unit of the Vermont Superior Court. The presiding judge for each county unit determines the allocation of judicial resources between Civil, Criminal, and Family Divisions within the unit and may specially assign a superior judge within a division of the unit to preside over one or more cases in a different division. Judicial assignments are for a specific length of time, usually one year. They are subject to the approval of the Supreme Court. Depending on the size of a unit, individual judges may sit in specific divisions. In smaller units the same judge may sit in all divisions. The Environmental Division has statewide jurisdiction. The Judicial Bureau also has statewide jurisdiction.

State commission drops one charge in investigation of Polk County Judge John Flynn

Flynn still faces possible reprimand, suspension.

The Florida Supreme Court has rejected one of two formal charges against Polk County Judge John Flynn, but he still faces the likelihood of a public reprimand and a 25-day suspension without pay.

The Investigative Panel of the Florida Judicial Qualifications Commission filed its amended findings and a recommendation of discipline on Wednesday, following an investigation over Flynn’s activities in the 2022 election. The inquiry centered on statements Flynn made suggesting a potential bias toward law enforcement.

In the amended recommendation, the panel removed one formal charge against Flynn, in response to a ruling from the Florida Supreme Court. The initial inquiry alleged that Flynn had violated a canon of judicial conduct on political activities. The Supreme Court, in a unanimous opinion issued March 21, rejected that stipulation from the panel’s agreement with Flynn.

The court returned the case to the commission for further proceedings. The panel had originally recommended a 30-day suspension for Flynn.

“The nominal reduction in the penalty from 30 days suspension to 25 days suspension reflects the Commission’s determination that the misconduct reflected in Count One is very serious,” read the amended notice of formal charges, signed by Gregory Coleman, chair of the commission.

Flynn, formerly a Bartow lawyer, won a contentious, five-person election for an open seat for Group 8 County Judge in the 10th Judicial Circuit in 2022. He led voting in the initial election and then defeated Ruth Moracen Knight in a runoff .

As The Ledger previously reported, the commission’s investigative panel submitted notice of formal charges against Flynn in October, asserting that he violated five rules of judicial conduct. The commission does not reveal who filed the complaint that led to the investigation.

The notice of charges included copies of campaign material and printouts of statements Flynn made on social media during the 2022 campaign. Flynn emphasized his background as a former assistant state attorney and expressed support for law enforcement, highlighting endorsements from Polk County Sheriff Grady Judd and the West Central Florida Police Benevolent Association.

Flynn’s campaign used the phrase “#supportlawenforcement” on social media, the panel reported. The notice cited such statements from social media as, “If you are a criminal you don’t want me on the bench” and “Criminals won’t be happy to see me on the bench …”

In the amended findings, the commission wrote that such statements conveyed “an inappropriate bias in favor of law enforcement agencies or against people accused of crimes.”

“Judge Flynn’s statements espousing support for law enforcement did not just occur in a vacuum,” the notice read. “His support of and by law enforcement was a theme repeated in his campaign.”

A member of the public questioned Flynn’s potential bias on social media, the notice said. While the commission does not prohibit judicial candidates from using a sheriff’s endorsement in a campaign, “the Commission believes that such questions should have reminded candidate Flynn about his ethical responsibility to avoid suggesting a bias,” the notice said.

As evidence of “damage” caused by the campaign statements, the commission noted that Chief Judge James Yancey had to move Flynn from his original assignment on criminal cases to small claims in response to the investigation, disrupting the normal rotation of assignments “in order to avoid assigning him to a criminal docket.”

Nick Sudzina, court administrator for the 10 th Judicial Circuit, said that Flynn would eventually be assigned to criminal cases after the investigation is resolved.

The Supreme Court rejected the second formal charge, which arose from Flynn’s appearance at a meeting of the Patriot Club of Lakeland, a conservative group, during the 2022 campaign, an event to which his runoff opponent was not invited, and later advertised the club’s endorsement of him.

The JQC’s investigative panel found that those actions violated judicial rules on attending political party functions or promoting party affiliations. In its opinion, though, the Supreme Court wrote that the findings contained no proof that the Patriot Club of Lakeland is a “political party.”

Under the heading “Mitigation,” the commission wrote that Flynn immediately accepted responsibility for his actions, cooperated with the investigative panel and “expressed regret that his actions have tarnished the judiciary and created the appearance of bias.”

Announcing the 2024 Graduation Ceremony Faculty and Student Addresses

Dear Students, Faculty, and Staff: Spring is here, and we are almost one month away from the School of Professional Studies Graduation. As we have in the past, the School will hold both morning and afternoon ceremonies so that our graduates and their loved ones may experience this milestone more intimately and comfortably. If you are participating in any of the events on Friday, May 10, you can find details  here .   I am thrilled to announce our faculty and student speakers for our morning and afternoon ceremonies. We have selected two distinguished faculty members to deliver separate faculty addresses, and both ceremonies will also feature student addresses. The faculty speaker for our morning ceremony will be Gregory J. Wawro, Ph.D., who is the director and founder of the M.S. in Political Analytics program. He previously served as the chair of the Department of Political Science at Columbia University. He holds his Ph.D. from Cornell University and specializes in American politics, including Congress, elections, campaign finance, judicial politics, political economy, and political methodology. Wawro is the author of  Legislative Entrepreneurship in the U.S. House of Representatives  and coauthor (with Eric Schickler) of  Filibuster: Obstruction and Lawmaking in the United States Senate , which is a historical analysis of the causes and consequences of filibusters. His most recent book,  Time Counts: Quantitative Analysis for Historical Social Science  (with Ira Katznelson), seeks to advance historical research in the social sciences by bridging the divide between qualitative and quantitative analysis through an expansion of the standard quantitative methodological toolkit with a set of innovative approaches that capture nuances missed by more commonly used statistical methods. Professor Wawro is currently working on projects that explore the role that social media is playing in congressional elections and democratic participation. Our faculty speaker for the afternoon ceremony will be Kristine Billmyer, Ph.D., who is a professor of professional practice in communication, dean emerita of the Columbia University School of Professional Studies (SPS), and director of the M.S. in Strategic Communication program at SPS. Dean Billmyer earned her Ph.D. from the University of Pennsylvania and her bachelor’s degree from Vassar College. She is a recognized scholar, educator, and consultant in gender equity, diversity, and cross-cultural variation in language. She teaches Gender and Communication in the Workplace and Global Communication for Professionals. An advocate for the advancement of women globally, she speaks frequently at national and international meetings. Billmyer is currently working on a longitudinal project on women’s empowerment in Japan. For our student speakers, the SPS faculty, staff, and students nominate two members of the graduating class each year as representatives. Our student speakers have the privilege of addressing their fellow graduates, reflecting upon their Columbia experience and sharing words of advice. The student speaker for our morning ceremony will be Michele M. Trizzino (’24SPS, Human Capital Management), and Elena Wilson (’24SPS, Nonprofit Management) will be the speaker for our afternoon ceremony. Michele M. Trizzino is the associate director of administration for the M.S. in Construction Administration program at SPS. Prior to this role, Trizzino was the inaugural advisor for the M.S. in Nonprofit Management program. She has a bachelor of science from St. John’s University, where she graduated summa cum laude and was valedictorian of her class. Trizzino was awarded “2021 Outstanding Woman” by the Women Builders Council, the leading association representing women in the construction industry. In 2022, the Columbus Citizens Foundation and ABC-7 featured Trizzino for her academic success and professional accomplishments as an Italian American. Trizzino sits on the Scholarship Committee for the Columbus Citizens Foundation, a nonprofit organization in New York City committed to fostering an appreciation of Italian American heritage and achievement. Elena Wilson is a Nonprofit Management student with a politics and finance background who wants to do good for her community. She graduated from Manhattan College with a bachelor of arts in government and a minor in psychology. During her time at Columbia, Wilson has served as a student representative on the University-wide Student Library Advisory Committee, been a University Life Ambassador for four semesters, served as treasurer for the Nonprofit Management Student Association, and served as both the nonprofit management representative and president of the School of Professional Studies Student Government. Outside of school, Wilson volunteers to register voters with Headcount.org and is a mentor for young women navigating sobriety. She is grateful to have been given the opportunity to connect with students, faculty, and staff members in order to help others and create inclusive spaces where people feel comfortable voicing their opinions. Thank you to all who have already committed to volunteering during our Graduation and Commencement activities. We encourage faculty to join the academic procession as marshals, and staff and faculty to volunteer as event hosts, to help create a memorable experience for our returning alumni.
